Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and the DegensQuest team (“DegensQuest”, “we”, “us”, or “our”) and govern your access to and use of the DegensQuest platform, including our Telegram bot @degensquestbot, our websites, applications, smart contracts, and related services (together, the “Services”).

By accessing or using the Services — including by adding our bot to a group, playing a game, or connecting a wallet — you agree to these Terms and to our Privacy Policy and Risk Disclosure, which are incorporated here by reference. If you do not agree, do not use the Services.

To use the Services, you represent and warrant that you:

• are at least 18 years old (or the age of majority in your jurisdiction, if higher);
• have the legal capacity to enter into these Terms and are not barred from using the Services under any applicable law;
• are not located in, a citizen or resident of, or organized under the laws of any country or territory that is subject to comprehensive sanctions, and are not on any restricted or sanctioned-persons list;
• will not access the Services from a jurisdiction where doing so, or where participation in token-based gaming or rewards, is prohibited or restricted.

You are responsible for ensuring that your use of the Services is lawful where you live. We may restrict access from certain jurisdictions at our discretion.

DegensQuest is a SocialFi gaming platform built on the Base network that turns Telegram groups into multiplayer game servers. Gameplay rewards may be settled on-chain in QUEST, the platform’s token.

QUEST is a utility token intended for use within the platform — for example, to access features, earn and spend in-game rewards, and participate in seasons and quests. QUEST is not an investment, security, share, deposit, or financial instrument, and we make no promise that it will hold or increase in value. You should read our Risk Disclosure in full before acquiring or using QUEST.

The Services are provided for entertainment. We may add, change, suspend, or remove games, features, rewards, and reward parameters at any time, including parameters that are governed on-chain.

You may access parts of the Services through your Telegram account and, where applicable, by connecting a self-custodial crypto wallet using Sign-In With Ethereum (SIWE) or a similar method. You are responsible for:

• maintaining the security of your Telegram account, wallet, private keys, and seed phrases;
• all activity that occurs through your account or wallet; and
• any transaction you sign or authorize on-chain.

We are non-custodial with respect to your wallet: we never take custody of your private keys and cannot reverse, recover, or refund on-chain transactions. If you lose access to your wallet, we cannot restore it for you. Notify us promptly of any unauthorized use of your account.

You agree to use the Services fairly and lawfully. You must not:

• cheat, exploit bugs, use bots, scripts, automation, or multiple accounts to gain an unfair advantage or to farm rewards;
• manipulate matchmaking, leaderboards, seasons, quests, or reward distribution, or collude to do so;
• reverse engineer, tamper with, or interfere with the Services, our smart contracts, or their security, anti-cheat, or rate-limiting measures;
• harass, threaten, defraud, impersonate, or harm other users, or post unlawful, hateful, or infringing content;
• use the Services for money laundering, sanctions evasion, market manipulation, or any other illegal activity;
• scrape, overload, or attempt to gain unauthorized access to any part of the Services or related systems.

We may investigate suspected violations and may suspend or terminate access, void unfairly obtained rewards, and report unlawful conduct to authorities.

You may submit content such as group names, messages, handles, and quest entries (“User Content”). You retain ownership of your User Content, and you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and use it as needed to operate, promote, and improve the Services.

You are solely responsible for your User Content and represent that you have the rights to submit it and that it does not violate these Terms or any law or third-party right. We may remove User Content that we reasonably believe violates these Terms.

The Services, including the DegensQuest and QUEST names, logos, game designs, software, text, and graphics (excluding User Content and third-party materials), are owned by us or our licensors and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Services except as expressly permitted. On-chain assets you lawfully acquire are governed by the rules of the applicable smart contracts and any associated documentation.

The Services rely on and interoperate with third parties we do not control, including Telegram, the Base network and the underlying Ethereum infrastructure, wallet providers, and decentralized exchanges and protocols such as the Uniswap v4 Hook that funds rewards.

Your use of those third-party services is governed by their own terms and policies. We are not responsible for their availability, security, fees, or actions, and your reliance on them is at your own risk. See our Risk Disclosure for more on third-party and network dependency risk.

The Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, that defects will be corrected, or that rewards, token value, or liquidity will be available or maintained. Blockchain transactions are irreversible and subject to network conditions outside our control. Nothing in the Services is financial, investment, legal, or tax advice.

To the maximum extent permitted by law, DegensQuest and its team, contributors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, tokens, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Services.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the total amount you paid us, if any, for the Services in the three months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless DegensQuest and its team, contributors, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your User Content, your violation of these Terms, or your violation of any law or third-party right.

We may update these Terms from time to time. When we do, we will revise the “last updated” date above and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the Services.

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of [JURISDICTION — to be set by counsel], without regard to its conflict-of-laws rules. The courts located in [JURISDICTION — to be set by counsel] will have exclusive jurisdiction, except where applicable law provides otherwise.

The specific governing law, venue, and any dispute-resolution or arbitration mechanism are placeholders to be finalized by qualified legal counsel before launch.
